Terms of Service

Please read these Terms of Service carefully before using the DriftSignal platform. By accessing or using DriftSignal, you agree to be bound by these terms. If you do not agree, do not use the service.

1. Definitions

"Service" means the DriftSignal API contract drift monitoring platform, including the web application, API, scheduler, dashboard, and all associated features operated by Drift Signal.

"Customer" or "you" means the individual or entity that has registered for a DriftSignal account.

"Content" means any data, specifications, API responses, or other information processed through the Service.

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials. You must notify us immediately at support@driftsignal.io of any unauthorised access to your account.

4. Billing and Payment

Paid plans are billed monthly in advance. All fees are non-refundable except as described in our Refund Policy. We reserve the right to change our pricing with 30 days' written notice. Failure to pay may result in suspension or termination of your account.

5. Free Plan

The Developer (free) plan is provided as-is with no uptime or support guarantees. We reserve the right to modify or discontinue the free plan at any time with reasonable notice.

6. Data and Privacy

Your use of the Service is subject to our Privacy Policy. We process API response data only to provide the Service. We do not sell your data to third parties. Credentials you provide are encrypted at rest using AES-256 encryption and are never logged in plain text.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Drift Signal and are protected by intellectual property laws. You retain all rights to your own data and API specifications.

8. Third-Party Services

The Service integrates with third-party providers including Stripe (billing), Clerk (authentication), Resend (email), and Railway (infrastructure). Your use of these services is subject to their respective terms of service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. DRIFT SIGNAL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRIFT SIGNAL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF DRIFT SIGNAL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO DRIFT SIGNAL IN THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless Drift Signal from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

Either party may terminate the agreement at any time. We may suspend or terminate your account immediately if you violate these Terms. Upon termination, your right to use the Service ceases and your data may be deleted after 30 days.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration under the American Arbitration Association rules.
